You cannot withdraw Pillar 3a savings whenever you choose. A new self-employed activity may qualify for early withdrawal, but an existing sole proprietorship does not thereby gain an unrestricted business credit facility. The legal basis is the BVV 3 ordinance, particularly Article 3 on payment, not a supposed BVG Article 11a governing 3a withdrawals.

Starting self-employment: check the withdrawal reason first

The federal third-pillar overview lists starting self-employment as a reason for early withdrawal. The statutory conditions, including ceasing to be subject to compulsory occupational pensions, must be checked. This is not the same as forming a GmbH or AG in which you remain an employee.

AHV recognition is important evidence, but a commercial register entry alone does not replace the assessment. Ask your 3a foundation to confirm in writing:

  • whether your actual status change qualifies;
  • which compensation office confirmation and other documents are required;
  • the application deadline measured from starting the activity;
  • whether written consent from your spouse or registered partner is required;
  • the consequences for any existing insurance benefits.

Federal guidance also lists giving up an existing self-employed activity and starting a different kind of self-employment as a possible reason. This is not an unrestricted right to repeat withdrawals for an existing activity. The foundation must assess the actual change.

The ordinary retirement withdrawal window

An ordinary retirement withdrawal is possible no earlier than five years before your personal AHV reference age. You do not have to stop working completely to use that window.

The benefit generally becomes due at reference age. If you continue gainful activity, you can defer for up to five years afterwards. Without the required continuing activity, the balance cannot simply remain indefinitely.

For women in the transitional cohorts, fact sheet 3.01 gives reference ages of 64 years and 3 months for 1961, 64 years and 6 months for 1962, 64 years and 9 months for 1963 and 65 from 1964. For men it is 65. Calculate your window from your own date, not a blanket “women at 64”.

Other statutory early-withdrawal cases

Federal guidance also lists, subject to conditions:

  • owner-occupied housing or repayment of mortgage loans;
  • permanently leaving Switzerland;
  • a whole IV pension where the disability risk is not insured;
  • a purchase into a second-pillar pension institution.

Each reason has its own evidence and limits. On death, the statutory beneficiary order applies, not simply a free distribution to all heirs. A partial IV pension or a diagnosis alone does not automatically establish a disability withdrawal reason.

Tax on the payment

A pension lump sum is taxed separately from other income. The actual burden depends on residence, amount, timing, family circumstances and other pension capital withdrawals. For people resident abroad, withholding tax and a double taxation agreement may matter. Do not automatically assume the last Swiss canton of residence applies, or a generic 2–5% rate.

For Swiss residents, the bank does not generally withhold the capital benefits tax. Set aside your own tax reserve and clarify assessment with the responsible tax authority. Withholding for someone resident abroad is a different case.

Multiple accounts: plan timing, not a guaranteed tax trick

Several 3a arrangements can allow withdrawals in different years. A universal statutory maximum of five accounts is not a reliable rule; providers may set their own limits. Capital benefits in the same year, and potentially spouses' benefits, can be aggregated for tax. Staggering therefore does not automatically mean every account is taxed independently from the bottom of the scale.

Before an early withdrawal for self-employment, ask the foundation and tax adviser which closures are permissible. An expected tax saving does not justify an invalid withdrawal reason.

Apply step by step

  1. Obtain written preliminary confirmation of the reason and personal conditions.
  2. Gather accounts, balances and existing risk-cover details.
  3. Weigh tax consequences and remaining retirement provision against the business's capital needs.
  4. Submit the foundation's form with the required evidence and consent.
  5. Keep payment confirmation and tax documents; do not record the payment as customer turnover.

If you do not withdraw the capital, you can continue your pension provision. The sole proprietor pension fund guide covers affiliation and vested benefits, while the retirement overview supports the broader plan.

Our guide to Pillar 3a for the self-employed explains how much you can pay in each year and which gaps from 2025 onwards you can make up.

Magic Heidi supports customer invoices and business expenses. It does not approve 3a withdrawals or determine withdrawal tax or a retirement shortfall.

Frequently asked questions

Must I stop working completely five years before reference age?

No. Ordinary 3a retirement withdrawal within the statutory five-year window does not require complete cessation of work. Deferral after reference age, however, requires continuing gainful activity.

Is a commercial register entry enough for a self-employment withdrawal?

Not on its own. The foundation checks the actual reason, status change and legal conditions. Confirm evidence and deadlines beforehand.
